Former Supreme Court Justice Abhay Manohar Sapre
has been appointed by the Central government as the new Chairperson of the
anti-corruption watchdog, Lokpal. Justice Khanwilkar is slated to serve in this
capacity for a term of five years, commencing from the date he assumes office
or until he reaches the age of 70.
Profile of Justice A.M. Khanwilkar:
At 65 years old, Justice Khanwilkar
practiced law in the Bombay High Court for over twenty years, focusing on
labor, industrial, and constitutional issues.
In 2013, he was appointed as a Permanent Judge of the Bombay
High Court. During his tenure exceeding two years in the Bombay HC, he
adjudicated upon numerous significant cases.
In 2015, Justice Khanwilkar was elevated to the Supreme
Court, where he served for over six years until his retirement in 2022 upon
reaching the age of 65.
Justice Khanwilkar has presided over several Constitution
benches that delivered landmark judgments on issues such as the SC/ST Act,
Aadhaar, Finance Act 2017, the Sabarimala matter, and reservations in job
promotions. Notable among his rulings are the confirmation of death sentences
for four convicts in the Nirbhaya gangrape case and the affirmation of the
Clean Chit awarded to Prime Minister Modi regarding the 2002 Gujarat riots.
About Lokpal:
The Lokpal, or anti-corruption ombudsman, is an autonomous
statutory body established under the Lokpal
and Lokayuktas Act, 2013, tasked with probing corruption allegations
against public officials.
The Lokpal's chairperson and eight members are appointed by
a high-level selection committee chaired by the Prime Minister and including
the Lok Sabha Speaker, Leader of the Opposition, and the Chief Justice of India
or a Supreme Court judge designated by the CJI.
Currently, the Lokpal has vacancies in the chairperson
position and three judicial member positions. Former Supreme Court Justice P.C.
Ghose completed his term as the inaugural Lokpal chief on May 27, 2022,
rendering the Lokpal non-functional since then.
With Justice Khanwilkar's appointment, the Lokpal will once
again have a regular chief to oversee its operations, though the shortage of
members persists, hampering its functioning.
Powers and Duties of Lokpal Chairperson:
Under the Lokpal Act, the Lokpal chairperson possesses supervisory and directional authority over the conduct of Lokpal affairs. Additionally, the chairperson is vested with control over all Lokpal officials and staff.
It is the chairperson's duty to constitute Lokpal benches and assign cases to various benches for inquiry and investigation into corruption complaints. The Lokpal chief and members are entrusted with probing corruption allegations against public servants ranging from the Prime Minister, ministers, and MPs to Group A officers and central government employees.
